Well, unless that party has a master recording license to upload music to a Youtube video, this would be considered copyright infringement. It would be copyright infringement because let's say for example, they didn't get the license to upload that song to a video. Knowing this, it's illegal to upload copyrighted music or even distribute it on Youtube; even if it's for nonprofit use.
So, it's definitely copyright infringement. Especially since they didn't even credit the original recording artist in the comments section as proof. They'd need to contact the record company to get permission, first. Then, they'd need to go and get the master recording license.
